Each sphere (national, provincial and local) of government has its own employment policy, which must comply with the following:

• Constitution of the Republic of South Africa of 1996
• Public Service Act of 1994
• Public Service Regulations
• Basic Conditions of Employment Act of 1997
• Labour Relations Act of 1995
• Labour Relations Act Regulations
• Employment Equity Act of 1998
• Employment Equity Act Regulations
• Any collective labour agreements concluded through the Public Service Co-ordinating Bargaining Council.

The Western Cape Policy is currently being re-formulated, but the policy at present is available here.
